Image 09 helps ASMP Legal Action Fund
Many thanks go to ASMP's NY Chapter's Image 09 for their $3000 donation to the ASMP Legal Action Fund. According to Member Frank Rocco, who ran Image 09, "The legal action fund is one of the most important things ASMP does. We are happy that contest proceeds will be used to fight for the rights of all working photographers."

  • ASMP, joined by the Graphic Artists Guild, the Picture Archive Council of America, and the North American Nature Photography Association, and several prominent individual photographers, has filed documents in opposition to the proposed settlement of the consolidated copyright infringement actions against Google instituted by the Authors Guild, Inc. and the Association of American Publishers, Inc. The four professional associations have joined forces, working together to oppose the settlement which excludes photographers and graphic artists from millions of dollars in payment, as well as from participation in future revenues to be generated by Google under the proposed settlement. According to the filing, the Proposed Settlement purports to serve both the public interest and the interests of the class members as well as Google, but it would, in fact, serve the financial interests of only a select few while irrevocably damaging the interests of others.   • Good news about last month's story of General Counsel Vic Perlman's work with AIA to reinstate the 2003 Copyright agreement with ASMP which limits the use of images and expands credit for usage. According to Perlman, "We are pleased to have received the news that the AIA fully intends to honor the terms of its agreement with ASMP.  They have told us they are currently working to ensure that the agreed upon release is used from this point forward." AIA also assures all ASMP members who have executed a non-compliant form that they will not assert any rights to images that are inconsistent with those stated in the 2003 agreement.

  • ASMP has filed comments in connection with two proposed regulation changes by the Copyright Office. ASMP stated that it "supports and encourages all Copyright Office attempts to improve the speed, efficiency and economy of the registration system" and therefore supports limiting the use of the deposit account system to pay for registration applications submitted in electronic form.  Alternatively, ASMP had no objection to doing away with the deposit account system entirely, as long as on-line registrations could be paid for easily and conveniently by debit/credit card or some similar on-line method.  In addition, concerning the proposed amendments relating to the mandatory deposit requirements for digital works published only on-line, "ASMP applauds even a limited exemption (from the mandatory deposit copy requirement)" and encourages the Copyright Office to explore the possibility of expanding the exemption.   ASMP's Executive Board met in Philadelphia on August 17th and 18th with a full agenda of ASMP business which was kicked-off with a discussion on Orphan Works with guests from Public Knowledge, a Washington, D.C.-based public interest group working to defend citizens' rights in the emerging digital culture.   In conjunction with Susan Carr's "What Do I Charge" seminar, ASMP will now offer a two-hour free workshop on registering your images with the copyright office. The first two workshops will be held on September 17th in San Antonio, TX and on October 2nd in Phoenix, AZ.
