ASMP Copyright Symposium a Hit!
|
|
© Ed McDonald
|
The April symposium, Copyright and the New Economy: Issues & Trends Facing Visual Artists was a big hit with the packed TimesCenter audience. According to ASMP President Richard Kelly, “During the coming year, ASMP plans to lead in moving forward on copyright issues and identifying sustainable business solutions for our changing world.” If you weren't able to attend, a video of the symposium is available on ASMP's website. It was a lively day with speakers from different vantage points in agreement that the present copyright system is out of sync with today's digital age. Therefore, creativity must be encouraged by finding solutions that allow independent creators to manage cultural change while maintaining rights to their art that allow for appropriate compensation.

General Counsel Victor Perlman warns of a decision that came down this week in the U.S. District Court for the Southern District of NY: Muench Photography, Inc. v. Houghton Mifflin Harcourt Publishing Co. et al. In essence, it invalidates most, if not all, of the copyright registrations that Corbis has made for its photographers. The decision will go through every level of appeal, starting with a motion for reconsideration. ASMP is actively involved and will keep you posted. If you have photographs that have been registered at the Copyright Office by Corbis, you should contact Corbis.

The Supreme Court has thrown out the conviction of a Virginia man under federal law aimed at banning videos that show graphic violence against animals, saying it violates the right to free speech. At issue was a 1999 federal law that makes it a crime to create, sell or possess videos and other depictions of cruelty to animals. The case arose over the conviction of Robert Stevens, who received a three-year prison sentence from a Western Pennsylvania court for selling videos that included scenes of hunting with dogs. According to ASMP General Counsel Victor Perlman, “ASMP participated in an amicus curiae brief in support of the videographer, and we are delighted with the ruling.” Read about U.S. v. Stevens

ASMP and its foundation have announced contributions to four major initiatives that fund the education and advocacy of student and emerging photographers, and the growth and development of established photographers. These are:
- Young Photographers Alliance (YPA) as a Major Founding Sponsor to bring students and emerging photographers opportunities for advancement.
- W. Eugene Smith Memorial Fund award to a photojournalist of exceptional talent, integrity and dedication
- Eddie Adams Workshop, Barnstorm, in which 100 photography students participate for an intense four-day gathering of top photojournalism professionals;
- Farnsworth Art Museum exhibitions of Arnold Newman's work to develop understanding and appreciation for photographic portraiture;
Support of these projects was made possible through funds received by ASMP from the Authors Coalition of America (ACA), the organization which distributes money collected for copying non-title-specific works abroad and is designated for use solely in industry education and advocacy.
