Copyright Registration Alert
ASMP has become aware that letters are going out from the US Copyright Office with recommendations on how to modify registrations using the online registration system and that some of you have received these. Several of these recommendations give us cause for concern and we are currently looking into possible actions and alternatives. We will advise members as soon as we have a suggested course of action and, in the meantime, if you have specific comments or questions, you can contact General Counsel Victor Perlman at perlman@asmp.org. • Note: Due to increased and enhanced enforcement of image licenses by various stock agencies, it is important for photographers with images in stock to notify their agencies when they are making a personal or promotional use of their own images such as placement in Find A Photographer or on a local ASMP chapter web site. This will help to avoid requests for payment for use by agencies.

  • ASMP and PACA have submitted an Amicus brief with respect to the appeal of the California District Court decision in Alberghetti versus Corbis Corporation to the Ninth Circuit . The issue on appeal involves whether the mere display of an image on a website for potential licensing violates California right of publicity law if the image portrays a recognizable person. Corbis' position, supported by PACA and ASMP is that the copyright owner and his or her representative has the right to display an image for potential licensing and that no state publicity law should interfere with that right . PACA was asked to present a brief outlining the harm to the image licensing industry as the result of the lower court's decision finding a violation of California publicity law. A number of media publishers presented an additional Amicus brief addressing First Amendment issues involved in accessing images for publication. Read the brief.
