ACA Funding for Education and Advocacy Received

ASMP has received $338,000 from the Author's Coalition of America (ACA), an association of organizations representing independent authors including illustrators, photographers, songwriters, text writers and visual artists. The money collected on behalf of unidentifiable American artists is distributed to ACA member organizations on the basis of established formulas and the funds are designated for use solely in industry education and advocacy.  ASMP's Executive Director Eugene Mopsik stated, " The funding received from ACA has enabled ASMP to offer numerous resources to the visual arts community, such as seminars and conferences delivered around the country, online business resources, and advocacy in the courts."

Stock Industry Changes: ASMP/APA Issue Statement

The latest version of the Alamy Contributor contract, published last month, included an important change: they announced an across-the-board 10% decrease in photographer's royalties. ASMP has reached out to Alamy to voice concern and has issued a joint statement with APA on the matter. ASMP will continue to work on the situation and keep members posted. On a more positive note, Image Source has announced that they will be offering a royalty rate of 60% for all imagery produced in North America, through Dec 31st 2013. According to Anthony Harris, the Group's Chief Operating Officer, "We want to distribute great images and generate great returns for our photographers and believe that this can only be achieved through a symbiotic relationship."

  • ASMP has recently released a white paper entitled Photography Competitions: What to Consider Before Participating. While competitions can give your work visibility, it is important to be sure you understand the issues before you enter. This paper contains ASMP's position on issues like Rights Assignment and Indemnification, and discusses a number of other important considerations for entering a photo competition. Read more.
  • ASMP has submitted comments with the US. Copyright Office on the subject of Resale Royalty Right, specifically on the Equity for Visual Artists Act of 2011 (“EVAA”) in the 112th Congress. It is ASMP's position that the bills as drafted are too narrow on defining a “work of visual art.” According to ASMP General Counsel Victor Perlman's comments, " ...any approach that is limited to sales only of originals and of signed, numbered limited editions draws an arbitrary and unsupportable distinction in the marketplace for works of visual art, and it should not be part of any federal resale royalty legislation."
