ASMP Issues "The Instagram Papers"

For some time, ASMP has been monitoring and reporting on the Terms of Service for social media distributors of images. After studying the current Instagram terms, we have determined that they are too far-reaching and unreasonable.

  • First, they grant Instagram a perpetual use license without any right of termination.
  • Second, they appear to give Instagram the right to license to third parties for any use whatsoever.
  • Finally, the rights holder is required to indemnify and hold Instagram harmless for any uses over which he or she has no control.

In the coming weeks and months, ASMP will reach out to other organizations and individuals to gain their support in addressing these egregious terms before they become the industry standard.  We have published comprehensive information on these terms here. and you will be hearing more through talks, social media messages, public relations, and events. 


ASMP Announces PhotoPlus Expo Programs

The PDN PhotoPlus International Conference & Expo, the largest photography and imaging show in North America, is coming to the Javits Center in NYC from Oct. 23-26. ASMP is offering these great programs:

  • Oct. 24th 8:45 - 11:45 am - Blake Discher will present Network to Get Inquiries, Negotiate to Make them Clients! 
  • Oct. 24th 4 - 6 pmPeter Krogh will moderate Practicing Safe Social Media with attorney Ross Buntrock, photography director for Huffington Post/AOL Anna Dickson and ASMP past president Richard Kelly 
  • Oct 25th 1:30 - 3:30 pm  - Judy Herrmann will present Earning a Living in a World where Everyone has a Camera
  • Oct 25th 4:00 - 6:00 pm Gail Mooney will moderate a panel on How Motion is Changing Still Photography with Chase Jarvis, Vincent Laforet, and Brian Storm
ASMP will also host a booth (right next to the US Copyright Office's!), hold the ASMP Annual Meeting on the 23rd, and offer free consultations for members only. More info to follow! To register for the show, click here.

Mopsik Addresses Congressional Committee About Copyright

ASMP's advocacy efforts continued on July 25th as Executive Director Eugene Mopsik testified about "The Role of Copyrights" before a committee of the U.S. House of Representatives in D.C. He was one of five individuals asked to participate in the hearing and his is the only testimony representing an organization of professional photographers. Mopsik was invited because of ASMP's history of leadership in the area of copyright. Read the testimony here.

  • ASMP is working with Facebook marketing expert Mari Smith to educate social media marketers about copyrights, privacy rights and social media terms of service. Richard Kelly will participate in an upcoming webinar interview for Smith's Business & Beyond Club members, and Judy Herrmann will contribute blog posts on Copyrights, Privacy & Publicity Rights  and Social Media Terms of Service . The webinar and posts will educate  bloggers and other social media marketers about why they shouldn't infringe copyrights or release other people's images onto social media sites without obtaining proper permissions.

ASMP Seminars 2013/14

ASMP's traveling seminars continue with:

  • Bill Cramer of Wonderful Machine's Real World Pricing & Negotiating, which uses real projects from real photographers to help you understand how to price and win jobs.
  • ASMP past president Richard Kelly's Releases, Trademarks & Privacy Rights, which shows you how to protect your assets and add value to your photos, and his new seminar on Winning the Copyright War, a discussion of the current and future state of Copyrights in the United States.

Lauren Greenfield was in residence this summer at Martha's Vineyard Film Centre, where she held an Artist Presentation and showed her films: Thin and The Queen of Versailles.

Matt Heron's photo of the 1965 Selma March was published in The New Yorker magazine in July.

Susan May Tell was featured in PDN Online in David Carol's column entitled Five Photographs, No Words: Susan May Tell. You can see the write-up and photographs here.

In Memoriam: Sadly, Steve Grubman passed away recently after a battle with cancer. He was a friend and great supporter of ASMP, as well as a great photographer. The Chicago/Midwest Chapter could always call on Steve for support and the use of his mammoth studio for events. Steve was an advertising, commercial, & corporate photographer specializing in animal photography and still-life.


ASMP Executive Director Eugene Mopsik traveled to Washington D.C. on August 1 to attend a hearing on U.S. Copyright law entitled "Innovation in America: The Role of Technology."

International Motion Art Awards 2 Call for Entries
