  • The ACLU has settled the case of Jerome Vorus v. District of Columbia involving the right to photograph police, and the D.C. Metropolitan Police Department issued a groundbreaking new General Order explicitly recognizing that "members of the general public have a First Amendment right to video record, photograph, and/or audio record MPD members while MPD members are conducting official business or while acting in an official capacity in any public space ." The order reminds officers that such activity "does not constitute suspicious conduct," and instructs officers that they "shall any way threaten, intimidate or otherwise discourage an individual from recording members' enforcement activities." Read the full text of the order here.
  • In related news, the NYPD is under fire about the recent arrest of New York Times photographer Robert Stolarik, who says he had his camera confiscated and was roughed up by police while documenting the arrest of a teenager in the Bronx. George Freeman, a lawyer for The Times, said the episode was "especially distressing " because the newspaper had been working with the Police Department since the Occupy Wall Street protests last fall, in which some journalists were denied access to certain areas or were arrested, to find ways to prevent the police from interfering with journalists in the course of their work. A court appearance for Mr. Stolarik is scheduled for November. Read more here.
  • Google Inc. asked a U.S. court to dismiss a lawsuit by authors over the digitizing of books last month, saying that the company's book-scanning program is a fair use of copyrighted material and a benefit to the public and authors. Google seeks dismissal of the Authors Guild's case, arguing that authors benefit from the project because their books can be more readily found, bought and read, while the public gains "increased knowledge." Google also argued that the display of snippets of text is fair use under copyright law and that the authors haven't been harmed by the display. Read more here. But on August 3rd, The Authors Guild asked the judge for a ruling in its favor on three legal issues, one of which is a claim for damages of $750 a book. The Guild also says it wants a ruling that copying books isn't a "fair use" under copyright law, as Google has said it will argue. Read more about this.
