ASMP At Photo Plus Expo!
PPE Logo ASMP is sponsoring and hosting a variety of events at this exciting photographer trade event, which will be held October 22-24th, 2009 at the Javitz Center in New York . You are invited to attend ASMP's Annual Member Meeting on Friday, October 23, 6pm to 8pm, to mingle with old friends, meet new ones and hear from Richard Kelly, Board President, Gene Mopsik, Executive Director and special Guest Speaker and Member Jack Hollingsworth.

ASMP Receives ACA Distribution
The Association has received $263,000 from the Author's Coalition of America (ACA), an organization which distributes money collected for copying non-title-specific works abroad, primarily in Scandinavia and Europe. Distributions are made periodically by ACA to visual arts organization members on the basis of an established formula, and funds are designated for use solely in industry education and advocacy. According to ASMP President Richard Kelly, "We are pleased that this distribution enables ASMP to continue to support the needs of photographers through educational outreach providing training in vital skills and fostering new ideas for our members and the photography community."

ASMP — There's an App for That!
FAP App In September, ASMP will go live with an i-phone app for Find A Photographer. This will make it easy to search for an ASMP photographer anywhere in the country directly from your i-phone. You'll be hearing more about this great new app in next month's ASMP NEWS.

  • When ASMP Member Andy Caulfield noticed the terms in a recent AIA Copyright Permission Form looked 'different,' he alerted General Counsel Vic Perlman. In 2003, Perlman and Executive Director Gene Mopsik had negotiated an agreement with AIA that created a "Memorandum of Understanding" on the use of photographs created by ASMP members and submitted in connection with AIA's award programs. The agreement limits the use of images and expands credit for usage. When Perlman looked into the matter, he learned that AIA had inadvertently lost track of the 2003 terms and the new forms expanded the usage requirements and terms beyond what was permitted under that agreement. Perlman is currently in communication with AIA to reinstate the 2003 agreement.

  • The Executive Board has approved ASMP's joining in an amicus curiae brief being filed on behalf of copyright owners appealing the case of Golan v. Holder. In this case, there was an unprecedented ruling in Federal Court that a portion of the Copyright Act is unconstitutional under the free speech provisions of the First Amendment. If the decision is allowed to stand, it raise the specter that other aspects of the Copyright Act will be challenged and could meet a similar fate, and potentially endangers US compliance with international agreements. Regardless of the Tenth Circuit decision, the losing party is virtually certain to appeal to the Supreme Court.

  • The Library of Congress Copyright Office has published a notice proposing new rules for registration of online works. These are currently under review by ASMP's GC Vic Perlman, who will decide what action ASMP wants to take, if any. The deadline to submit initial comments is August 31, 2009. More information to come.
