FAP Facebook Page Now Live!

ASMP's Find A Photographer now has its own FB page to showcase the work of ASMP members. Every other week, a new artist will be featured, starting with winners of the Best of ASMP . This dynamic new page will be promoted to art buyers so they can see first-hand the talent and professionalism of ASMP members. They will also be able to link to the FAP site and app. To make the site as vibrant as possible - please visit and "Like" it.  And, ASMP Second Vice President and Social Media Committee Chair Ed McDonald says, "It would be great if members would blast out messages to their personal list of art buyers to tell them about the new FB page so they can sign in and visit regularly. By doing this, you are reinforcing the ASMP brand - and, by extension, your personal brand." To see the new page, go here.

Help ASMP Respond to the Copyright Office

ASMP is concerned about new fees recently proposed by the US Copyright Office. You can review all the new proposed fees here. These include increasing the registration fee for filing an online claim from $35 to $65, and raising the fee for using a paper application from $65 to $100. The Copyright Office has requested comments by next month, and ASMP is gathering information for a response. Members will soon receive an email and be asked to take a short online survey about  current registration practices and the effects this increase would have. Please be on the lookout for this and help us create a powerful response by taking the survey!

  • The Office of the Intellectual Property Enforcement Coordinator (IPEC) released their 2011 Annual Report outlining the activities of the Office and its progress towards implementing the Office's 2010 Joint Strategic Plan. The Office is required to submit such a report every year by the PRO-IP Act of 2008. The report highlights the Administration's increased law enforcement action against pirated goods over the past year and its increased focus on China as the number one source of infringing products seized at the U.S. border. It also notes the progress of the legislative reforms the Office recommended to Congress in March of 2011 to strengthen IP enforcement and touts the role the Office played in establishing the Copyright Alert System as well as voluntary best practices for payment processors to reduce sales of pirated goods over the internet. You can read the report here.
  • The Second Circuit recently overturned the grant of summary judgment to YouTube in Viacom International Inc. et. al. v. YouTube Inc. et. al . In this decision, the Second Circuit reversed portions of a 2010 decision by the U.S. District Court for the Southern District of New York that YouTube is not liable for copyright infringement on its service. The appellate court vacated parts of the earlier ruling, and sent the case back to lower court for trial. Key to the decision was a determination of whether YouTube was entitled to rely on "safe harbor" provisions in the Digital Millennium Copyright Act (DMCA). The lower court had concluded that because YouTube lacked sufficient knowledge about specific infringements on its site, it could rely on the safe harbor provisions to excuse liability.
